ACORN Dumps Sensative Documents

Fox News is reporting that, “a private investigator says he found tens of thousands of sensitive documents dumped outside a California ACORN office just days after the state attorney general announced an inquiry into the community organizing group.”

Derrick Roach, a licensed investigator based in San Diego, told FoxNews.com he paid an impromptu visit to the city’s ACORN branch on Oct. 9 and watched from his car as a man tossed bags of files into a Dumpster outside the building.

After ACORN staff left for the day, he says, he searched the trash bin and discovered more than 20,000 documents he believes point to illicit relationships between ACORN and a bank and a labor union — as well as confidential information that could put thousands at risk for identity theft.

“We’re talking people’s driver’s license numbers, dates of birth, Social Security numbers, credit card numbers, bank account numbers, tax returns, credit reports” — all tossed in public view in the Dumpster, he said.

In one document shared with FoxNews.com, an ACORN employee’s name, address, date of birth, Social Security number and driver’s license number were revealed, and photocopies of the employee’s license and Social Security card were also included. Another document showed bank account information for a woman paying an ACORN membership fee by check.

“It was just a careless disregard for the people that ACORN claimed to be helping,” Roach told FoxNews.com. “They put these people at risk.”

Roach said that data breach laws bar dumping like the kind he uncovered at ACORN’s office. Tossing the documents into a Dumpster, he said, constitutes a crime in California.

“So if someone wanted to, they could bring legal action against ACORN for doing this,” he said.

A top ACORN official in California apologized for the lapse Monday, saying that some confidential information might have been thrown away during a massive clean-up of their offices last month.

“In early October, when our San Diego staff were doing an office clean-up in preparation for a major 10-station phone bank program being set up in our offices, it appears that included in the piles of garbage being thrown out may have been some documents containing private information,” said Amy Schur, state head organizer for California ACORN, in an e-mailed statement.

Schur implied that “this guy” Roach, a former Republican candidate for statewide office, may have had political motivations for unearthing the documents. She said ACORN would seek the return of the documents “so that we may give proper notice of the compromising of the information as required by law.”

Roach told FoxNews.com he has been going over the trove of ACORN files and has found connections to the California Teachers Association and to Citibank.

“ACORN was acting as an agent” for Citibank, Roach charged. “They had mortgage information for homeowners … who were in foreclosure, who were in default.”

Roach says that the documents suggest that ACORN staffers would go out on “assignments” to take pictures of some residences or even to “go out and actually make contact” with people living in homes financed by Citibank loans.

He said he believes Citibank will have to report to its customers that their information may have been at risk when ACORN threw it away. “They took information and they just dumped it in the garbage,” he said.

Citibank ran an outreach program through ACORN that utilized the group’s local staff to encourage homeowners at risk of defaulting on their mortgages to contact the bank and work on avoiding defaults. That relationship has since been severed, a spokesman for Citigroup told FoxNews.com in an e-mail.

“Over time, Citi has worked with a variety of not-for-profit partners, including ACORN, to provide financial education, meet affordable lending needs, promote stable homeownership for low- to moderate- income consumers and help in foreclosure prevention,” the spokesman said.

“We are deeply concerned about the recent media reports regarding ACORN. We recently suspended our charitable financial support and program relationships with ACORN, and we are waiting for the results of the independent audit of ACORN’s activities now underway.”

Roach also charged that the California Teachers Association, the state’s largest teachers’ union, was “funneling information to ACORN for political activity” — a relationship that he said would not be illegal but would require ACORN and the CTA to disclose fully.

“I’ve done some checking into the reports that have been filed for the CTA, for ACORN, and I’m not finding any of this information being disclosed,” he said. He did not provide any documents illustrating the relationship to FoxNews.com.

CTA spokesman Mike Myslinksi said the union had no comment on documents it had not seen. “That’s out of left field,” he said.

Roach’s accusation comes in the wake of a national scandal for ACORN, the Association of Community Organizations for Reform Now. Staffers were caught on tape this summer in six cities offering to help a pair of filmmakers posing as a pimp and prostitute to lie to the IRS and acquire illegal home loans.

Below you will find a two-part article about the real source of “Inspiration” for ACORN and Obama. The article is written by David Horowitz, author of the new book, One-Party Classroom: “How Radical Professors at America’s Top Colleges Indoctrinate Students and Undermine Our Democracy”

Part 1

Glenn Beck will be on vacation this week but when he returns on the 24th he has invited me to come to New York to talk to him on camera about Saul Alinsky, the strategy guru of the Obama era. For the the Hillary-Soros generation of johnny-come-lately radicals and their ACORN footsoldiers, Alinksy is their Sun-Tzu and his book Rules for Radicals is the field manual for their struggle. I thought while I’m refreshing my acquaintance with this destructive fellow and re-reading his text, I would share my thoughts with you, serially over the next week.

For this first post, let’s just focus on the dedication of the book — to Satan:

“Lest we forget, an over-the-shoulder acknowledgment to the very first radical:” (Pause there for second. Now continue): “from all our legends, mythology, and history(and who is to know where mythology leaves off and history begins — or which is which), the first radical known to man who rebelled against the establishment and did it so effectively that he at least won his own kingdom — Lucifer.”

So Alinsky begins by telling readers what a radical is. He is not a reformer of the system but its would-be destroyer. This is something that in my experience conservatives have a very hard time understanding. Conservatives are altogether too decent, too civilized to match up adequately, at least in the initital stages of the battle, with their adversaries. They are too prone to give them the benefit of the doubt. They assume that radicals can’t really want to destroy a society that is democratic and liberal and has brought wealth and prosperity to so many. Oh yes they can. That is in fact the essence of what it means to be a radical — to be willing to destroy the values, structures and institutions that sustain the society we live in. Marx himself famously cited Alinsky’s first rebel (using another of his names — Mephistopheles): “Everything that exists deserves to perish.”

This is why ACORN activists, for example, have such contempt for the election process, why they are so willing to commit election fraud. Because just as Lucifer didn’t believe in God’s kingdom, so the radicals who run ACORN don’t believe in the democratic system. To them it is itself a fraud — an instrument of the ruling class, or as Alinsky prefers to call it, of the Haves. If the electoral system doesn’t serve all of us, but is only an instrument of the Haves, then election fraud is justified because it is a means of creating a system that serves the Have-Nots — social justice. Until conservatives begin to understand exactly what drives radicals and how dishonest they are — dishonest in the their core — it is going to be very hard to defend the system that is under attack. For radicals the noble end — creating a new heaven on earth — justifies any means. And if one actually believed it was possible to create heaven on earth, would he not willingly destroy any system hitherto created by human beings?

The many names of Satan, by the way, are also a model for radicals who camouflage their agendas by alternatively calling themselves Communists, socialists, new leftists, liberals and most consistently progressives. My parents, who were card-carrying Communists, never referred to themselves as Communists but always as “progressives.” The Progressive Party was run by the Communist Party and split off from the Democrats in 1948 (because Harry Truman opposed Stalin), but rejoined the Democrats in the McGovern campaign of 1972 and with the ascension of Barack Obama has become the Democratic Party.

Alinsky’s tribute to Satan as the first radical, and as the model of radicals to come, should cause us to reflect on how Satan tempted Adam and Eve to destroy their paradise. If you rebel and violate the law that has been laid down for you, “You shall be as gods” the serpent told them. You think Rahm Emmanuel was listening?

Oh, and let’s not forget this — the kingdom that the first radical “won” was hell.

Part 2

Picking up where we left off, Obama/Acorn strategy guru Saul Alinsky began his manual for leftists by dedicating it to Satan, “the first radical known to man” who “rebelled against the establishment, and did it so effectively that he at least won his own kingdom.” We noted that the kingdom Alinsky thought was some kind of achievement to inspire other radicals was in fact hell. Here in a nutshell is why conservatives are conservative and why radicals are dangerous. Because conservatives pay attention to the consequences of actions, including their own, and radicals don’t.

One kind of hell or another is what radicalism — progressivism — has achieved since the beginning of the modern age when it conducted the first genocide in the Vendee during the French Revolution. In a fever of revolutionary enthusiasm the Jacobins had changed the name of the cathedral of Notre Dame to the “Temple of Reason” and then in the name of Reason proceeded to slaughter every Catholic in the Vendee region to purge supersitition from the earth. It was the precursor of Lenin’s destruction of 100,000 churches in the Soviet Union and the creation of a People’s Church to usher in the kingdom of socialist heaven which led to the murder of 100 million people in Russia and China and the bankrupting of a continent before it mercifully collapsed — with progressives cheering it all the way and mourning over its demise. It was also the precursor of Pol Pot’s decree that every Cambodian who wore glasses be killed in order that Cambodia be rid of bad ideas.

Not every progressive hell is a genocide but many come close. The crusade to rid the mankind of the scourge of DDT launched by the American environmentalist Rachel Carson wound up killing 100 million children mainly black Africans under the age of 5 between 1975 and the present, and the killing is still going on. The crusade of the left to liberate gays from a “sex-negative culture” destroyed the public health system’s ability to control domestic epidemics and led to the deaths of more than 300,000 gay men in the prime of life.

The left’s crusade to build a welfare utopia destroyed the inner city black family, spawned tens of millions of fatherless black children and created a mass intractable and violent underclass which is still with us and growing today.

The leftist monopoly of the public school system in America’s major cities is daily destroying the lives of millions of poor black and Hispanic children while filling the coffers of the Democratic Party machine which keeps their oppression going.

But progressives never stop for a moment to look at the horrors they have wrought.

Look at the defense Alinsky’s disciples are making of the Obama socialized medicine plan as they ask distressed constituents at the townhall meetings, do you have Medicare and do you like it? That’s a government health care system that works. Oh? So why is it going bankrupt? Isn’t that the reason for the new system? This one of course is much bigger, so the bankruptcy will be much more painful and destructive. But there wouldn’t be a need for this “solution” and the price of medical care wouldn’t so outrageous, if progressives hadn’t devised the present system in this first place.

So one rule for conservatives should be this: Don’t be so polite. When progressives propose their progressive solutions, remind them of the hell they have inflicted on the people they claim to want to help — gays, blacks, Hispanics, children. And that’s just for starters.

WASHINGTON. D.C. – A report released today by Rep. Darrell Issa (CA), the Ranking Republican on the House Oversight and Government Reform Committee, presents evidence that ACORN has evaded taxes, obstructed justice, engaged in racketeering, and created a conspiracy to defraud the United States.

“This report is a comprehensive and substantive examination of an organization that has operated in secrecy and outside the law,” Issa, also a member of the House Judiciary Committee said. “There are number of legitimate questions raised about the political activities and organizational structure of ACORN. This report is about getting to the truth and when there are significant accusations and questions outstanding regarding an organization that has benefited from millions of taxpayer dollars, those questions should be answered and the truth should be brought to light.”

“The Association of Community Organizations for Reform Now (ACORN) has repeatedly and deliberately engaged in systemic fraud,” according to the report’s executive summary. “Both structurally and operationally, ACORN hides behind a paper wall of nonprofit corporate protections to conceal a criminal conspiracy on the part of its directors, to launder federal money in order to pursue a partisan political agenda and to manipulate the American electorate. Emerging accounts of widespread deceit and corruption raise the need for a criminal investigation of ACORN.”

The report includes significant new information about wrongdoing brought to the attention of committee investigators by ACORN whistleblowers.

Highlighted in the report:

  • ACORN has evaded taxes, obstructed justice, engaged in self dealing, and aided and abetted a cover-up of the $948.607.50 embezzlement by Dale Rathke, the brother of ACORN founder Wade Rathke.
  • ACORN has committed investment fraud, deprived the public of its right to honest services, and engaged in a racketeering enterprise affecting interstate commerce.
  • ACORN has committed a conspiracy to defraud the United States by using taxpayer funds for partisan political activities.
  • ACORN has submitted false filings to the Internal Revenue Service (IRS) and the Department of Labor, in addition to violating the Fair Labor Standards Act (FLSA).
  • ACORN falsified and concealed facts concerning an illegal transaction between related parties in violation of the Employee Retirement Income Security Act of 1974 (ERISA).

“It is outrageous that ACORN will be rewarded for its criminal acts by taxpayer money in the stimulus and is being asked to help with the U.S. census,” said Rep. Issa. “This report shines a light on clear criminal conduct and it is abundantly clear that they cannot and should not be trusted with taxpayer dollars.”

A Fox News story reports that according to a new report from Republicans on a House oversight committee, ACORN engaged in a scheme to use taxpayer money to support a partisan political agenda.

Do we really want this organization involved with the 2010 Census?

The report, released Thursday, accuses ACORN of fraudulent activities and widespread corruption and calls for a criminal investigation into the advocacy group. It offers the first detailed account of the allegations that have dogged the organization in recent months.

ACORN, or the Association of Community Organizations for Reform, has been under constant fire from conservatives since last year for its support of Barack Obama’s presidential candidacy and its planned participation in next year’s 2010 census.

The report was released by Rep. Darrell Issa, the top Republican on the House Committee on Oversight and Government Reform, and Issa’s GOP colleagues.

“This report is about getting to the truth and when there are significant accusations and questions outstanding regarding an organization that has benefited from millions of taxpayer dollars, those questions should be answered and the truth should be brought to light,” Issa said in a statement.

The executive summary of the report says ACORN provided contributions of financial and personnel resources to indicted former Illinois Gov. Rod Blagojevich, Ohio Sen. Sherrod Brown and candidate Obama, among others, in what the report calls a scheme to use taxpayer money to support a partisan political agenda, which would be a clear violation of numerous tax and election laws.

“Both structurally and operationally, ACORN hides behind a paper wall of nonprofit corporate protections to conceal a criminal conspiracy on the part of its directors, to launder federal money in order to pursue a partisan agenda and to manipulate the American electorate,” an executive summary of the report reads.

ACORN, which was sent a copy of the executive summary by FOXNews.com, dismissed the report as a “partisan attack job.”

“We are busy fighting to stop the foreclosure crisis, to win quality affordable health care for all Americans and to build a stronger economy for working families, so we haven’t had the opportunity to read Rep. Issa’s screed at length,” Bertha Lewis, CEO of ACORN, said in a written statement to FOXNews.com.

“But an initial review indicates that the document is a recycled and repackaged partisan attack job on ACORN’s good work,” she added.

The report accuses ACORN, after receiving more than $53 million in federal funds since 1994, of blurring the legal distinctions among 361 tax-exempt and non-exempt entities to divert that money into partisan political activities.

Evidence found in the report relies in part on documents provided by former ACORN employees.

“Operationally, ACORN is a shell game played in 120 cities, 43 states and the District of Columbia through a complex structure designed to conceal illegal activities, to use taxpayer and tax-exempt dollars for partisan political purposes, and to distract investigators,” the report read.

“Structurally, ACORN is a chess game in which senior management is shielded from accountability by multiple layers of volunteers and compensated employees who serve as pawns to take the fall for every bad act.”

Kurt Bardella, a spokesman for Issa, said ACORN’s response suggests the report “hit a nerve.”

“We stand by the findings of the report,” he told FOXNews.com. “There are a lot of legitimate questions raised about the political activities and organizational structure of ACORN. We’d certainly like to have a venue and platform for ACORN to respond to our report.”

In his statement, Issa said, “It is outrageous that ACORN will be rewarded for its criminal acts by taxpayer money in the stimulus and is being asked to help with the U.S. census. This report shines a light on clear criminal conduct and it is abundantly clear that they cannot and should not be trusted with taxpayer dollars.”

It would be up to the chairman of the oversight panel to hold hearings on the ACORN report and up to the Justice Department to pursue a criminal investigation. Likewise, the census director will determine whether ACORN remains a partner with the U.S. Census Bureau to assist with the recruitment of the 1.4 million temporary workers needed to go door-to-door to count every person in the United States.

A spokeswoman for Rep. Edolphus Towns, chairman of the House Oversight Committee, did not respond to e-mails seeking comment.

Census Should Partner With Post Office, Not ACORN

ACORN has changed it’s name and is attempting to silence its critics with lawsuits.

The new name, Community Organizations International, “will let ACORN leaders continue their operations without worrying about prior bad publicity, according to Marcel Reid of ACORN8, a group of present and former members.”

The following are excerpts from the article:

“Association of Community Organizers for Reform Now (ACORN) leaders are using the threat of a law suit to silence and intimidate critics, according to current and former members of the liberal activist group. In a letter dated June 11 an attorney for ACORN advised top whistleblowers that their unauthorized use of the organization’s name could make them liable for monetary damages and injunctive relief.

ACORN executives have also changed their organization’s name, which was tarnished by investigations in at least 14 states of allegations of voter registration fraud during the 2008 presidential campaign, and charges by current and former members of financial mismanagement and misrepresentation.

The new name will let ACORN leaders continue their operations without worrying about prior bad publicity, according to Marcel Reid of ACORN 8, a group of present and former members.”
